Training Business and government education and training regional administrative penalties

La Direzione Generale per l'Attività Ispettiva del Ministero del Lavoro e delle Politiche Sociali, con interpello No 3 of February 2, 2011, responded to a question from the University of Bergamo, on the chance to play the students' attitude in training workers in the production and sale of goods and services in relation to all institutions of education and training regional properly credited for the provision of services in DDIF (right to education and training), regardless of the legal nature of the donor.

The answer in short:

"... Moreover, pursuant to art. 20, paragraph 5 of the said A, activity didattica può riferirsi a tutte le attività produttive dell’Azienda, fermo restando che “gli eventuali utili rinvenienti dalla predetta attività sono destinati, nell’ordine, alla copertura dei relativi costi ed al miglioramento ed incremento delle attrezzature didattiche”.
Ciò premesso, sebbene proprio nella Regione Lombardia l’attuale sistema di Istruzione e Formazione Professionale (IFP) preveda la possibilità di erogazione di servizi di istruzione e formazione professionale da parte di soggetti accreditati presso l’istituzione regionale in possesso di specifici requisiti (v. D.D.U.O. n. 2298/2008 e D.D.U.O. n. 5808/2010 che richiede, fra l’altro, la natura non profit del the donor), it is possible to consider that as explained by the aforementioned Ministerial Decree, about the possibility of carrying out this "training in business planning" into productive initiatives of the "schools" participating in activities directed and / or instrumental to the sales team, general principle. In this sense, therefore complies with the overall framework applicable regulated directions believe this training method for learning "in the real situation" - said as effectively directed to overcome the reality gap between education and employment - all the educational institutions and regional training regolarmente accreditati per l’erogazione dei servizi in DDIF, indipendentemente dalla natura giuridica del soggetto erogatore."
