Safety at Work. Brief comments on corrective decree World

Technorati Tags: Safety at Work, 626 ,

(Dr. Charles Teri-Inspector of Labour)

extend brief remarks on the corrective decree on security on from work recently approved and promulgated, the exclusive result of the thought of this writer.

As you know the Decree 81 of April 9, 2008, in force since 15.05.2008, health and safety at work and in practice has the story including the previous legislation is now being reviewed by 626/94 corrective decree in the said Decree is revolutionizing the original assumption that the legislative floor.

on 306 articles of Decree No. 81/2000 have been modified over 130.

Apparently the intention of the legislature tends to simplify the text only, but the original structure of the legislation is significantly affected.

Among the significant changes apparent to the repeal of the ban on medical examination prior to the assumption by the medical officer of the company (Article 41, paragraph 3, letter a) specifications, as laid down in Article 5 of L300/70 (Workers' Statute). Impressed a real narrowing of the likelihood of employee health record ( because of the changes and cancellation of certain paragraphs of Article 25 of that Decree No. 81/08), it also identifies the analysis and a corrective reading of a reduction of the structure of employee training booklet. Compress the protection of workers ineligible for the job. You do not surrender to the most representative workers' safety, the Risk Assessment Document (DVR), and the drafting of that document refers to 90 days of taking productive. Indeed, in enterprises with substantial contributions of risk is important that the risk assessment prior to the commencement of the activity.

The current legislature with amending decree states that workers have to notify the employer has not elected its head of internal security and therefore the employer will communicate that fact, no longer to 'Inail, but rather the joint bodies, whose bodies (they are also classic expression of the employers' side) and it is not yet established in most of the country ..

With Article 2 bis of the decree in question also gives bilateral bodies to certify the proper implementation of technical standards and appropriate action to be taken, and actually compress the responsibilities of employers and managers, who may not respond to the effects of new rules of the death or injury if the event is due to a charge, designer, competent doctor, worker, self-employed (Article 15a). This reduces most of the penalties for employers, managers and responsible, and against the workers are assigned responsibilities (see Article 59 of Decree corrective).

On the signal is significant that the legislative responsibilities of accidents can be attributed to the worker and not the one who organizes the production.

Matter of workers' safety with the corrective undergoes marked a turning point in my opinion. With the Supreme Court Judgement No 18998 of May 6, 2009, determined that the mistakes made by workers for injuries on the job, do not erase the guilt of the company. With the introduction of corrective action in other pronunciations jurisprudential analysis we have to wait to see if the structure of protection for the parties has changed and whether the applicable standards for safety at work have actually suffered substantial disruptions in the past.

Mr. Eugenio Verbena

The gradual growth in recent times, the mortgage payments began to determine the psychological state of customers' financial anxiety, so much so that the subject has increased public attention, the consumer associations and the media.
The "dear mortgages has thus assumed value of social problem and the consequent intervention of the legislature to determine conditions of increasing flow market creating more competition between operators and increasing customer expectations in terms of responses to the needs to modify the choices made originally on their mortgages. First
spoke Bersani Decree (January 31, 2007 7 converted with amendments into Law No. 40 of April 2, 2007), in particular, introduced the withdrawal without penalty and the transferability of the loan. [1]
This provision prohibited any agreement, even after the conclusion of the contract, including the penalty clauses, which is agreed with the borrower to request early repayment or part of a loan agreement is bound to a particular benefit for the subject lender (da intendersi comprensiva non solo delle penali di anticipata estinzione, ma anche di qualsiasi altro genere di prestazione a carico del mutuatario, come ad esempio le spese di emissione dei conteggi di anticipata estinzione).
Further estimates of the so called "mortgage portability" - in a cyclical factors related to trends in interest rates and the housing market - has made immediate application of the rule then record a significant demand for loans for replacement "in a more competitive environment no doubt
This case essentially provides the ability of the borrower-debtor taking a loan a sum of money to pay a previous loan, make over to the mutuante nei diritti del precedente creditore, anche senza il consenso di questo: riconosce, cioè, al cliente il diritto (non rinunciabile, né sottoponibile ad oneri o altre condizioni) di surrogare un nuovo mutuante nei diritti (e nelle garanzie) di un precedente finanziatore, nel rispetto delle condizioni fissate dal codice civile per l’attivazione dell’istituto della surrogazione per volontà del debitore (art. 1202 c. c.).
This decree, said Convention and the attached, were placed in order to facilitate the payment of installments of variable rate home loans through a mechanism that would reduce and stabilize the amount of the installment, following rates interest in recent times.
To this end, banks have sent to customers holding variable rate mortgages and installment for the duration, no later than August 29, 2008, a proposal for renegotiation, containing an indication of the rate renegotiated to allow them to assess the impact the new installment in its budget and an initial indication of the effects that the mechanism could generate ovviamente sulla base di una ipotetica stabilità, per tutta la durata del mutuo, del tasso di interesse contrattuale applicato alla ultima rata in scadenza.
Per i mutui stipulati, rimborsati parzialmente, rinegoziati o accollati dopo il 31 dicembre 2006 l’importo della rata rinegoziata è determinato sulla base del tasso relativo the first installment of depreciation following the signing, the renegotiation, the partial extinction and with shouldering.
The amortization schedule is not changed and the loan continues to be set at a floating rate and the spread of contract.
The difference between the amount of the installment and the renegotiated contract is charged to an account funding enhancement, which will mature on capitalized interest annually at a fixed rate equal to the lesser of the IRS (Interest Rate Swap) to 10 plus 0, 50 points and the contractual rate of the loan, respectively, to the date of renegotiation and the last installment due.
If the difference between the amount of installment contract and the renegotiated gender balance to the borrower, the difference is charged to the account credit enhancement funding. If, as a result of these credits, debt financing on behalf of accessory to zero, the installment amount is applied to the lower of the contract and the renegotiated (the bill funding accessory can never have a credit balance).
After amortization of the loan, any debt arising on account of enhancement funding is reimbursed by the customer according to a new repayment plan in equal installments an amount equal to that of the installment resulting from the renegotiation developed at a fixed rate equal to the lesser that applied to enhancement funding account and the rate of the loan contract refers to the original expiration date.
guarantees already included in support of the loan renegotiation continue to assist the repayment of the debt financing on the income resulting enhancement, whose extinction can apply the simplified procedure provided for by the extinction del'ipoteca n.7/2007 Bersani decree.
And, finally, after renegotiation, subrogation and scrapping the expensive loans to address a new revolution has arrived for the loans through a contribution of the state.
Moreover, by Decree Law 185 of November 29, 2008 (the so-called anti-crisis decree), [3] First State is responsible for the loan extent to which the interest rate on the excess of 4% for moderation to some extent the calculation of the first installment on home mortgages.
For all installments due in 2009, will be paid by the State's share of interests in excess of the limit of 4%: in other words, the borrower will pay the bank the contractual rate (normally Euribor plus a spread) if below the threshold 4% and where the application rate of Wallpaper the ceiling of 4%, the excess will be paid to the bank by the state (in a manner to be determined by a subsequent decision of the Inland Revenue).
Eligible for the state loans concluded by October 31, 2008, which provide for any indexing system degli interessi, compresi quelli che concedono l'alternativa tra tasso fisso e variabile e che, al 31 ottobre 2008, si trovassero in un periodo di applicazione del tasso variabile, stipulati da persone fisiche per l’acquisto, la costruzione e la ristrutturazione dell'abitazione principale (escluse abitazioni di lusso, castelli e ville), purché detti mutui (in linea di massima quelli stipulati fra il 2003 e metà 2006) al momento della sottoscrizione prevedevano un tasso inferiore alla soglia del 4% (comprensivo dello spread).
Lo stesso decreto prevede inoltre che la clientela nel 2009 ha la possibilità di stipulare mutui ancorati al tasso praticato dalla Banca Centrale Europea (Bce) nei finanziamenti al sistema bancario, considering the recent turmoil in the interbank market that made the Euribor a parameter can not be trusted.
In fact, since 1 January 2009, banks are obliged to offer to customers who so request rate loans indexed to the ECB, with the requirement that the so-called "finite rate" is "in line with that charged for other forms of indexing tenders' (the use of these products, that is, the customer can not be more expensive than other similar products offered by the bank).
short, clients have been proposed in recent times, various solutions to the decree by the Bersani Decree Tremonti, the decree dens-crises, proposals of each bank.
If by the end of 2008 can be generally considered the operation ended the so-called compulsory renegotiation of mortgages granted three months to the borrower, the bank's receipt of the proposal to recalibrate the loan according to the average of the rates current in 2006 , remain standing the possibility of subrogation of the old mortgage by obtaining a new loan with another bank as well as the renegotiation of the terms offered by their bank in an environment that has become increasingly strategic in the use of the bank, which, for the new loans, was added as an option for the European rate.
Furthermore, many banks are now reviewing their business strategies towards the old customers and potential customers just to maintain or strengthen its market share and presumably there will be an enrichment of new types of mortgage.
no coincidence that the anti-crisis decree entrusted the task to the Bank of Italy to enact regulations to ensure adequate transparency.
And, indeed, the Bank of Italy has promptly issued specific instructions [4], and to ensure the transparency of information regarding the new types of mortgages, and to expand the background information of banks on their products.
is prescribed that "disclosure is provided to customers covering all types of mortgage offered by the bank, to facilitate the choices of customers to products that are potentially more suited to his needs. "
In this regard, banks should clearly show the typical characteristics and risks of the various operations of mortgage offered to customers, and that in order to facilitate the understanding of the main differences between the different products offered.
From 1 March 2009, banks should prepare a document with information on mortgages offered. In particular, it should at least be the subject of advertising in relation to several products: a) the interest rate (an indication of whether it is fixed or variable and, in the case of variable rate the spread, the benchmark rate and the amount of advertising at the time), b) the minimum and maximum duration of the loan; c) the terms of depreciation, d) the frequency of installments.
The document should be sent, at the first earnings statement - but no later than April 15 - even to customers who have a loan outstanding with the bank.
In conclusion, the mortgage world is revealed a changing environment, in which - also as a result of legislative action - you can measure the ability of the individual bank's market-making strategies with targeted offers and provided with appropriate support and advice and especially for customers with adequate disclosure and transparency, the elements - the latter - which certainly will be the subject of attention especially by the Supervisory Authority.

The Bank of Italy is entrusted to enact provisions to ensure adequate publicity and transparency in the provision of such contracts and related conditions.
In this regard, banks that offer mortgages are required to prepare, with reference to the new contract mentioned in the introduction with effect from 1 January 2009, documentation of transparency in accordance with the applicable provisions. protest the inability of consumers to see the encrypted channels della Rai e degli altri operatori nazionali

Tatuaggi terapeutici sono stati ritrovati sulla Mummia del Similaun (ca. 3300 a.C.) ritrovata in 1991 the Italian Alps, with tattoos also find more complex than is that of 'man of Pazyryk "in' Central Asia with intricate tattoos representing animals. Among the ancient civilizations that developed the tattoo was Egypt but also the ancient Rome, a crossroads of civilization, where it was prohibited by Emperor Constantine after his conversion to Christianity ("There'll incisions in the flesh for a death, or you will get tattoos to off. I am the Lord "Leviticus 19:28 '). It is also noteworthy that, before Christianity became the religion and lawful, then the state religion, many Christians tattooed on Skin religious symbols to mark our own spiritual identity.

is also attested in the Middle Ages the custom of tattooing pilgrims visited shrines of religious symbols, especially that of Loreto. Among Christians, the practice of tattooing is widespread among the Coptic Monophysite. By stressing the Copts tattoo their Christian identity, the subjects are usually the Coptic cross, the Nativity and the Holiness Mar Corios, martyred under Diocletian and represented riding a horse with a child. [1] The Jewish religion prohibits tattoos permanent, as prescribed in Leviticus (Vaikrà) (19, 28). In particular, Judaism prohibits each recording accompanied by a brand of indelible ink or other material that leaves a permanent record.

Other people who developed their own styles and meanings were those related to the sphere of Oceania, in which each particular area despite the similarities, it has clearly defined traits. Famous as Maori, and also between the peoples of Mount Hagen, Japanese, Chinese and even though the Inuit population had almost every characteristic symbols and their meanings.

in the European area the tattoo was subsequently reintroduced to the ocean explorations of the eighteenth century, they did know the customs of the inhabitants of Oceania. At the end of the nineteenth century the use of tattoos also spread between the classes European aristocrats were famous tattooed, for example, Czar Nicholas II and Sir Winston Churchill. It should be noted that the criminologist Cesare Lombroso believed, in an age of positivism, the tattoo be a sign of delinquent personality. The spread of tattooing in all social strata and among very diverse people in the last thirty years relegates such criminological considerations to a mere historical curiosity.

Techniques tattoo

Running a tatuaggio.Gli Inuit use of bone needles to pass a wire through the skin covered with soot (the slope, which hand and improperly shall work for the purpose is ultimately an aqueous suspension of soot).

In oceanic areas the tattoo is done through the teeth of a comb of bone that stopped at the end of a wand, and beaten by another stick, pierce the skin by introducing color, the latter obtained from processing of coconut.

The Japanese, with the technique called "tebori, use thin metal needles and pigments of many colors, and introduce substances into the skin of different chemical nature and different color. The Japanese technique requires that the needles are permitted in the skin at an angle, with less violence, but still fairly doloroso.

In such contexts the experience of pain (which is rejected by us: this is only required American technology) is essential, as the individual approaches death and the endurance of pain is exorcising against the same. In addition to the experience of pain, blood loss is essential. The blood is the indicator for excellence in life: to shed blood, in a controlled and reduced, when you run a tattoo means to simulate a symbolic death.

Among the most popular substances are cinnabar (used for red), cromossido (for green) and cobalt (for blue) or fine particles of minerals, gold or silver.

elimination techniques

The most widely used treatment for tattoo removal is surgical and the method with better results in the removal by laser. Alternative treatments can be dermabrasion or cryotherapy.

The alternative to the total elimination through laser, often with exorbitant costs, is the overlap of the old tattoo side of a new subject (usually slightly larger and more elaborate of the old) performed by a recognized professional.

The health risks

More or less large, with or without writing the traditional tattoos last forever, but over the years become lighter if they are not performed by a professional, usually do not cause side effects may occur rarely, however, allergies to dyes used.

In any case it is always preferable to the use of experts operating in suitable environments, in the best hygienic conditions and use disposable instruments, since otherwise there is a risk of contracting infections also very serious, among which are the ' Hepatitis B and C, tetanus, AIDS, leprosy and infections skin staph. In literature there are reports of statistical correlation between the performance of a tattoo and the occurrence of sarcoidosis or of a pseudolymphoma. It is also very rare event.

Post-run tattoo
treatment shown here is obviously on a regular tattoo done with sterile equipment and tattoo machines.

The practice of healing a tattoo normally consists of applying a bandage (often directly to the study of the tattoo artist) to be removed after 1-3 hours to flush (possibly with a mild soap) removing excess color. Since then it is advisable to take the air and cover the tattoo several times a day with a thin veil of soothing and protective ointment (Bepanthenol). The choice of product depends on the advice of the tattooist and is still widespread use of petroleum jelly and cream-type Nivea moisturizer "or similar. The tattoo shall be washed daily and completely healed in 20-30 days.

During the first week is generally recommended to abstain dall'esporsi to sunlight, from taking baths in public pools or on the water and remove any scabs that may come to form. Generally

however, see the advice to treat the tattoo the tattoo artist gives to the term of their work, while the intervention of a doctor takes over when you create various kinds of complications in the healing process.

Allergic reactions
Allergic reactions to pigments in the colors are rare, except for certain types of red (cinnabar, mercury compound) and green. The skin of people allergic to certain metals may react with pigments swelling, itching and the discharge of pus. These reactions appear rarely, but we recommend perform a special test before having the tattoo.
There are minimal risks of anaphylactic shock in hypersensitive individuals.
There are also rare cases of rejection of the ink, resulting in permanent damage to aesthetics of the area concerned, it is therefore advisable to undergo specific tests before tattoos, at least for the first time.

stay tattoo
The semi-solid tattoo pigment is incorporated by cells in the dermis of the skin, holding it in permanently. Who has second thoughts and wants to remove his tattoos trust or dermabrasion (a very aggressive because they scrape off the skin from 1 mm to 2 mm thick if the color has penetrated deep), risking visible scars, or laser, which vaporizes only the blackened skin cells, not by bleeding and not causing pain (by this method are not scars, but the new layer of skin may be a different color), or cryotherapy.

Ethics tattooist

A tattoo artist at work. A tattoo artist has the task to put on your skin so indelible a drawing. For liability granted it, he must be conscientious person with knowledge of the trade. A serious tattooist, the customer provides detailed information on risks and charges involving the sessions that are consistent with a job.

The customer who goes for the first time in the studio of a professional tattoo artist is given a questionnaire to fill out health and hygiene. Moreover, a serious tattoo artist is concerned to understand what the real motivations of the customer and prevent them, driven by temporary reasons or minor, is undergoing treatment which could then repent.

From hygienic point of view, the customer must be informed about the study methods used for sterilization and cleaning of rooms and instruments.

The sterilization system is far preferable to the saturated steam autoclaves obtained.
The autoclaves are tested regularly and kept in the study and performed tests to clients.
The tattoo artist should wear gloves, gowns and masks.

Every culture, whether it be Japanese or Polynesian, assigns to each symbol is a term, then care would be at least one of the parties concerned informed about the significance of what you want to perform. It should be noted that in traditional societies' s misuse of the symbol borders on sacrilege.

Profiles legal tattoo
5 Codice Civile. The Supreme Court has clearly ruled that the execution of the tattoo is for health (Section VI Criminal Appeal 25 January 1996 and May 29, 1996). In relation to the question of whether the execution of a tattoo as a supplement to the crime of injury is observed that under Article. 50 of the Penal Code, the consent of the right applies as justifications, no problem for the tattoo artist can properly decide whether the customer. Different is the case in which an unemancipated minor requires to be tattooed. Given that this is someone who can not properly dispose of their rights (and, consequently, be validly consent pursuant to Art. 50 Criminal Code) is good that the tatuatore non esegua il tatuaggio senza una dichiarazione d'assenso di chi, genitori o tutore, esercita la potestà genitoriale sul minore . 1218 Civil Code) or tort (ex art. 2043 Civil Code), the tattooist must follow all the rules of conduct hygiene and customer information point well described in the section on the ethics of tattooing. It is to be expected that the work of tattoo artist, in most cases has the nature of self-employment under Articles. 2222 and the Civil Code. It is a good rule of prudence liability insurance business following the self-employed person, the tattoo artist to determine whether the insurance companies offer specific contracts for their businesses. Currently no state law governing the Italian tattoo, although the matter is already the subject a resolution of the Council of Europe, which should comply with the laws of individual states. The above resolution, on 19 June 2003, recommends the introduction of specific legislation on products for the permanent tattoo of a discipline and administrative rules of hygiene to be observed. Currently, national legislation level ad, it appears that only Belgium, France and Switzerland have already legislated on the practice of tattooing. In relation to Italy there is still a law (or act having the force of law) to the relevant state. Some regions (Piedmont, Tuscany) have also placed on the legislative power under scheduled art. 117 of the Constitution. These laws also force only unfold within the territory of the Region which has legislated. Finally, it should be noted that the call for public tenders relating to certain sectors of public employment (for example in law enforcement) may indicate why the presence of unfitness of tattoos concealed by the uniform, disfiguring or considered by the Medical Commission charged with assessing the suitability of the candidates indicated abnormal personality. It is clearly a distant echo of the theories that Lombroso was mentioned above. Who is considered to be inappropriate for that reason will naturally bring the courts in the form of Administrative Law.

I tatuaggi "old school"

I tatuaggi "new school"
Per anni uno dei classici della tradizione americana, have been considered for a symbol of masculinity and machismo, and therefore boycotted by the world of tattooing. Recently, in conjunction with the birth of the "new school" there was a rehabilitation and re-interpretations is easy to see that.

Tribal
is the name given to that category of tattoos has emerged since the early nineties and is based on the traditional tattoos of the natives of various islands of the Pacific (Samoa, Marquesas Islands, Hawaii), the Dayak of Borneo, the Maori of New Zealand and Native Americans.

The tattoo horimono in its current form was developed in the late nineteenth century, and has undergone ups and downs in popularity in Japan, having been forbidden in the law and reinstated several times. It was a typical decoration of that segment of Japanese society called "floating world", which included prostitutes, gamblers' s gambling, gangsters, small traders, but was especially prevalent among the firemen, the mafia and laborers, in the class "high "and the samurai was very rare to find examples. The most classic traditional Japanese tattoo designs are:
dragons, cherry blossoms, a symbol of transcendence and evanescence of Life Fudomyo-O, Japanese version of the Buddhist deity Acalanatha, furious version of the Buddha shishi, and stylized depiction of the mythological lion
koi carp, a symbol of courage and perseverance masks hannya or demonic masks used in the Japanese No theater, portrayed in tattoos hebi with apotropaic value, snake, symbol of courage Bonji writing characters that are used in Japanese ideograms bhuddismo esoteric verses, quotations or entire parts of the Buddhist sutras Hou-ou bird, like the phoenix Western Kilin or Kirin, a mythical animal with the value of luck
kiku, botan chrysanthemum flowers, peony flowers
lotus paintings drawn from nineteenth-century prints Ukyo-e
these themes are often combined with the second classic combinations, for example:

the dragon is depicted preferably with the chrysanthemum, the lion is preferably tattooed with the peony, creating a classic combination called "Kara-Jishi" Hannya masks are preferably combined with snakes and Buddhist symbols like the lotus and the roll of the sutras, or petals and cherry blossoms.

Biomechanical
Inspired by the work of Hans Ruedi Giger, this type of tattoos had his moment of glory in the eighties and early nineties.

tattoos biomechanical creatures are usually composed of organs or limbs inextricably fused with human parts.

Food Security: The White Paper 'EUROPEAN COMMISSION'

Technorati Tags: food safety , White Paper, the European Commission

A series of crises concerning food and feed (BSE, dioxin) has identified the shortcomings in the design and implementation of food regulation in the European Union. This situation has prompted the Commission to include the promotion of a high level of food safety among its political priorities for the coming years.

The White Paper on Food Safety is a key element in this strategy .

La Commissione ha formulato inoltre i principi which should focus on the general European policy on food safety:

  • a global, integrated, which applies to the entire food chain;
  • a clear definition of roles of all parties involved in the food chain (producers of animal feed, farmers and food operators, Member States, the Commission, consumers);
  • the traceability of food for humans and animals and their ingredients;
  • coherence, effectiveness and the dynamism of the food policy;
  • risk analysis (including assessment, management and communication risks);
  • independence, excellence and transparency of scientific advice;
  • the application of the precautionary principle in risk management.

Darker Skin Pubic Area

Highway Code: the New

Autovelox
La riforma dice definitivamente addio agli autovelox "a sorpresa", imponendo che l'apparecchio nelle strade long distance can not be located over a mile from the signal with the speed limit. But the news come to cripple the interest of the municipalities to do with cash fines. The pick comes from the revenue forecast that sanctions should not be more who puts the camera, but the owner of the road. The mayors of many small towns that had turned "their" stretch of road in a hen that lays golden eggs, then they would have no interest in strafe fines motorists. The rule, however, offers new chance to the provinces, which handles many rural roads. Cade can also rent cameras and equipment for traffic light violations, paying off with a share of rental revenues, municipalities could only use tools they own or lease. There will also be a 3% cut in government transfers to municipalities that do not devote themselves to improving the road network at least 50% of the money to motorists. Fines Possible

the deferral rate to 60 if the fine exceeds 400 euro, affecting those who have an annual income of less than € 10,628. Young people and alcohol

Those who have already pocketed the license for the scooter will get the pink sheet to 17 years. In the first three years by licensed, however, will be subject to license suspension longer than one third (the first offense) or half (from subsequent offenses) than those for other motorists. In the case of newcomers to the steering wheel, then the new rules provide for a zero tolerance for alcohol, a fine of € 155 (double that if you cause an accident) for those in the first three years of the license is caught with a BAC greater than zero. The same rules are provided for the driver by profession. For all other is the European limit of 0.5, with fines starting at 500 € and license suspension for up to two years. More severe penalties in case of accident.
Cyclists
New requirements for incoming cyclists, outside built-up areas and in tunnels must wear reflective vests. The reform, however, focuses on the protection of pedestrians, leading to 8 points for those who can cut their transit on the strips. (Source ADOC.it)
