Mediation and Conciliation, what are they?

Under article 1 mentioned above, the term "mediation" shall mean the activity, however named, conducted by an impartial third party and aimed to assist two or more entities, both in finding an amicable agreement for the composition proceedings, both in the formulation of a proposal for the resolution of the dispute.

Il mediatore.

L’ organismo d conciliazione.

Il registro.

Si intende il “ registro ” degli organismi di conciliaizione così come meglio disciplinato dal decreto ministeriale n.180 del 2010 che stabilisce i criteri e le modalità di iscrizione e tenuta del medesimo registro.

Soggetti della mediazione.

In base all’art.2 del decreto legislativo n.28 del 2010, chiunque può accedere alla mediazione.

Oggetto della mediazione.

La mediazione ha oggetto la conciliazione di una controversia civile e commerciale vertente esclusivamente su diritti disponibili, nel rispetto di quanto previsto dal decreto legislativo n.28 del 2010 il quale, comunque, non preclude le negoziazioni volontarie e paritetiche relating to civil and commercial disputes or complaints procedures laid down in the card services.

Modalità della domanda di mediazione.

La domanda di mediazione si presenta mediante il deposito di una istanza presso un organismo.

In caso di più domande relative alla medesima controversia, la mediazione si svolge davanti all’organismo presso il quale è stata presentata la prima domanda.

Per determinare il tempo della domanda si ha riguardo alla data di ricezione della comunicazione.

Contenuti minimi della domanda di mediazione.

La domanda di mediazione deve contenere: a) denominazione dell’organismo; b) dati anagrafici delle parti; c) oggetto della domanda; d) ragioni della pretesa.

Doveri di informazione da parte del difensore.

All’atto del conferimento dell’incarico, l’avvocato è tenuto a informare il cliente della possibilità di avvalersi del procedimento di mediazione e delle relative agevolazioni fiscali di cui agli articoli 17 e 20 del decreto n.28/2010.

L’avvocato, altresì, informa il proprio assistito – clearly and in writing - in situations where the experiment is a condition of admissibility of the mediation proceedings.
